All Items Subject to Prior Sale: All items are subject to prior sale or other disposition. The Seller does not guarantee availability of every item advertised.

Terms: All items are offered F.O.B. seller’s warehouse at 140 53^rd Street, Brooklyn, NY 11232, with payment in full and all funds cleared prior to delivery. Wire transfer instructions are available upon request.

Specifications: Quoted specifications are approximate and non-binding.

Assembly: Items may be delivered disassembled in whole or in part. Reassembly is the sole responsibility of the purchaser.

Final Sale: All sales are final and without any right of return or adjustment.

No Warranty:

·         ALL ITEMS ARE SOLD WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND.

·         THE SELLER MAKES NO WARRANTY OF MERCHANTABILITY.

·         THE SELLER MAKES NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

·         All items are sold as-is and where-is.

·         The buyer has inspected the item(s) offered or has had a full and fair opportunity to so inspect and has declined to do so.

·         The buyer has not relied upon the skill or judgment of the seller in selecting or evaluating the item(s) purchased.

Products Liability:

·         The buyer represents that it is in a better position to convey warnings and promote safety to users and operators than the seller is, and the seller reasonably relies on the buyer to communicate such information to users under its control.

·         The seller represents (and the buyer acknowledges) that the seller exercised no control over the design or manufacture of the items offered for sale.

·         The buyer is solely responsible for assuring that the items offered comply with all federal, state and local safety laws, rules and regulations.

Conflicting Terms: Any buyer terms or conditions (whether contained in a purchase order or otherwise) that conflict with these terms and conditions shall be null and void.
